Terms of Service

These are the terms that govern how ChileJam Productions builds, hosts, and maintains websites for our clients. They protect both sides. We've tried to write them the way we'd want them written if we were the client reading them.

1. About these terms

These Terms of Service ("Terms") apply to every project, service, and ongoing engagement provided by ChileJam Productions ("ChileJam," "we," or "us"). By making any payment to ChileJam — whether for a build, a monthly service plan, or any other service — you ("Client" or "you") agree to be bound by the version of these Terms in effect at the time of payment.

We may update these Terms from time to time. The current version always lives at chilejam.com/terms. Continuing to use our services after we update the Terms constitutes acceptance of the updated version. Material changes will be communicated by email at least 30 days before they take effect for existing clients.

2. What we provide

We are a small studio. We take on a limited number of new builds at a time, by design. The founder reviews every project.

3. Pricing and payment

Build fees

Build fees are structured as follows:

"Launch notification" means written confirmation from ChileJam that the site is live at the agreed-upon domain and ready for use. Net-7 means the invoice is due within 7 calendar days from that notification.

A note about the schedule below: we've kept payment terms tight because we're a small studio, not a utility. Every late invoice is a real cost to us. The schedule isn't about being inflexible — it's about being honest with you and with ourselves about what's sustainable. You'll always hear from us before anything happens to your site. Reminders go out at every stage. Nothing is suspended without notice.

If the launch invoice is not paid within 7 days, the site will be taken offline on day 8 and will remain offline until the invoice is paid. We do not extend grace periods on launch invoices.

Monthly service plan

All ChileJam-hosted sites require an active monthly service plan. The plan covers hosting, security, monitoring, and ongoing maintenance as detailed in Section 5. The current monthly service fee is $75 per month, billed on the same calendar day each month, beginning on the site launch date.

The billing date is fixed for the life of the engagement. Late payment does not reset the billing schedule. Payments made after the due date are applied to the past-due balance; the following month's invoice is still due on the original billing date.

Payment methods

Recurring monthly fees are processed via Stripe Subscriptions. Build fees may be paid by credit card, ACH, or other agreed methods. Clients are responsible for keeping payment information current.

4. What's included in a build

A standard ChileJam multi-page build at the base price ($999) includes:

Single-page builds ($350) include a subset of these items appropriate to a single page. Multi-page builds beyond 5 pages are priced per project.

5. What's NOT included

The following are not included in a base build and are available either as separate add-ons or are not services we offer at all:

If you need any of these services and we offer them, we'll quote them separately. If we don't offer them, we'll tell you and may refer you to someone who does.

6. Revisions and post-launch changes

During the build

Two rounds of revisions are included in the base build fee. A "round" is defined as a single batch of revision requests submitted by the client, executed by ChileJam, and returned as an updated build. Multiple piecemeal emails sent during a round are bundled into the active round; they do not reset the round counter.

Additional revision rounds beyond the included two are billed at $150 per round or $125 per hour, whichever is less.

After launch

The line between "covered" and "billable" after launch is based on scope, not on type of change:

What the monthly service plan covers

The $75 monthly service plan covers, in addition to hosting and infrastructure (see Section 7):

Unused minutes do not roll over. Overage beyond the included monthly time is billed at $125 per hour in 30-minute increments, with prior written approval before work begins.

Rush requests. Standard edit requests are returned within five business days. If you need a change handled ahead of the standard queue, a rush request is available at $250 per request, subject to availability. Rush handling is not guaranteed — we will accommodate it when our schedule allows and will tell you promptly if we cannot.

The $75 monthly service plan bundles hosting, infrastructure, and service into a single fee. The plan includes:

Sites without an active monthly service plan cannot remain online. Termination of the service plan results in the site being taken offline as described in Section 10.

What you own

What ChileJam owns

The simplest way to think about it: you're not buying a website from ChileJam. You're hiring ChileJam to provide a website for your business as a service. Your domain, your content, and your brand are yours. The code that makes it work is ours, the same way an architect's blueprints remain the architect's property even after your house is built.

Code release / buyout

The release fee compensates ChileJam for the custom code, components, and design system you'd be taking with you. We've priced it accessibly enough for a real move, deliberately enough that it isn't a casual decision.

If you ever want to take the source code with you and host it independently, you may purchase a code release for a flat fee of $2,500. The code release includes:

The code release does not include ChileJam's reusable design patterns, internal management tools, build configuration, or the right to resell or relicense the code to third parties.

10. Termination

Either party may terminate

Either party may terminate the engagement with 30 days written notice. On termination:

Design work starts the moment a project begins. Time blocked on our calendar can't be unblocked. That's why fees are earned at the start of work, not at completion.

All payments to ChileJam are non-refundable. This includes:

If a project is canceled before any design work begins, the upfront payment is refunded minus a $100 administrative fee. Once design work begins, fees paid are earned regardless of project outcome.

12. Liability

ChileJam Productions provides services on an "as-is" basis and makes no warranties beyond those explicitly stated in these Terms. Without limiting the foregoing:

13. Confidentiality

Both parties agree to keep confidential any non-public business information shared during the course of the engagement. ChileJam will not share, sell, or disclose client business information to third parties without consent, except as required by law or as necessary to provide the services. Clients agree not to disclose ChileJam's proprietary methods, internal tools, or processes to third parties.

14. Changes to these Terms

We may update these Terms from time to time. The current version always lives at this URL. We will notify existing clients by email of material changes at least 30 days before they take effect. Continued use of ChileJam services after the effective date of an update constitutes acceptance of the updated Terms.

15. Governing law and disputes

These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws provisions. Any dispute arising from these Terms or from ChileJam services will be resolved first by good-faith negotiation between the parties. If negotiation fails, disputes will be resolved by binding arbitration in Denton County, Texas.
