Terms of Service
These are the terms that govern how ChileJam Productions builds, hosts, and maintains websites for our clients. They protect both sides. We've tried to write them the way we'd want them written if we were the client reading them.

1. About these terms
These Terms of Service ("Terms") apply to every project, service, and ongoing engagement provided by ChileJam Productions ("ChileJam," "we," or "us"). By making any payment to ChileJam — whether for a build, a monthly service plan, or any other service — you ("Client" or "you") agree to be bound by the version of these Terms in effect at the time of payment.
We may update these Terms from time to time. The current version always lives at chilejam.com/terms. Continuing to use our services after we update the Terms constitutes acceptance of the updated version. Material changes will be communicated by email at least 30 days before they take effect for existing clients.
2. What we provide
ChileJam Productions designs, builds, hosts, and maintains custom websites. Our services include:
- Custom website design and build. Static HTML, CSS, and JavaScript sites deployed to Cloudflare Pages.
- Site copywriting. Based on source material provided by you.
- Hosting and ongoing service. Bundled together as a single monthly plan.
- Photography and AI image generation. Where included in a project scope.
- Additional add-on services. Available as separate engagements (see our Studio page for current offerings).
We are a small studio. We take on a limited number of new builds at a time, by design. The founder reviews every project.
3. Pricing and payment
Build fees
Build fees are structured as follows:
- Single-page sites: Payment due in full before work begins.
- Multi-page sites ($999 and up): 50% due on signed agreement to begin work. The remaining 50% is due net-7 days from launch notification.
"Launch notification" means written confirmation from ChileJam that the site is live at the agreed-upon domain and ready for use. Net-7 means the invoice is due within 7 calendar days from that notification.
A note about the schedule below: we've kept payment terms tight because we're a small studio, not a utility. Every late invoice is a real cost to us. The schedule isn't about being inflexible — it's about being honest with you and with ourselves about what's sustainable. You'll always hear from us before anything happens to your site. Reminders go out at every stage. Nothing is suspended without notice.
If the launch invoice is not paid within 7 days, the site will be taken offline on day 8 and will remain offline until the invoice is paid. We do not extend grace periods on launch invoices.
Monthly service plan
All ChileJam-hosted sites require an active monthly service plan. The plan covers hosting, security, monitoring, and ongoing maintenance as detailed in Section 5. The current monthly service fee is $75 per month, billed on the same calendar day each month, beginning on the site launch date.
The billing date is fixed for the life of the engagement. Late payment does not reset the billing schedule. Payments made after the due date are applied to the past-due balance; the following month's invoice is still due on the original billing date.

Payment methods
Recurring monthly fees are processed via Stripe Subscriptions. Build fees may be paid by credit card, ACH, or other agreed methods. Clients are responsible for keeping payment information current.
4. What's included in a build
A standard ChileJam multi-page build at the base price ($999) includes:
- Up to 5 pages of custom design
- Fully mobile-responsive layout
- Site copywriting based on source material you provide (existing copy, marketing materials, business descriptions, services lists, FAQs)
- One contact or lead-capture form
- Basic search engine optimization (page titles, meta descriptions, OpenGraph tags, sitemap.xml, robots.txt)
- Google Analytics 4 setup
- Microsoft Clarity setup (heatmaps and session recordings)
- Meta Pixel installation (where relevant)
- Favicon design
- Up to 10 custom AI-generated images created with our preferred AI image tools
- Initial deployment to Cloudflare Pages on your domain
- Two rounds of revisions during the build phase
- 30 days of post-launch bug fixes (anything broken or not working as designed)
- DNS migration support
Single-page builds ($350) include a subset of these items appropriate to a single page. Multi-page builds beyond 5 pages are priced per project.
5. What's NOT included
The following are not included in a base build and are available either as separate add-ons or are not services we offer at all:
- Blog or news sections
- E-commerce or payment processing
- Multi-language sites
- Custom illustrations beyond AI-generated images
- Professional photography (priced separately as a ChileJam service)
- Logo design
- Ongoing content writing (blog posts, articles, social media copy)
- Ongoing SEO strategy or campaigns
- Google Ads or Meta Ads management (priced separately)
- Email marketing platform setup (Mailchimp, ConvertKit, etc.)
- Social media account creation or management
- Customer-facing admin panels (available as a paid add-on)
- Hosting on platforms other than Cloudflare Pages
If you need any of these services and we offer them, we'll quote them separately. If we don't offer them, we'll tell you and may refer you to someone who does.
6. Revisions and post-launch changes
During the build
Two rounds of revisions are included in the base build fee. A "round" is defined as a single batch of revision requests submitted by the client, executed by ChileJam, and returned as an updated build. Multiple piecemeal emails sent during a round are bundled into the active round; they do not reset the round counter.
Additional revision rounds beyond the included two are billed at $150 per round or $125 per hour, whichever is less.
After launch
The line between "covered" and "billable" after launch is based on scope, not on type of change:
- Bug fixes (anything broken or not working as designed) are covered by the 30-day post-launch warranty at no cost.
- Small content edits and updates (text tweaks, image swaps, contact info changes) are covered by the monthly service plan.
- Changes to design elements, content, or features that were delivered and approved during the build — including "I changed my mind" requests — are billable as maintenance work or as separate quoted requests.
- New pages, new features, or redesigns are not maintenance and are quoted as separate projects.
What the monthly service plan covers
The $75 monthly service plan covers, in addition to hosting and infrastructure (see Section 7):
- Up to 30 minutes of content edits per month
- 5-business-day turnaround on standard edit requests
- Email-based submission to a dedicated ChileJam address
Unused minutes do not roll over. Overage beyond the included monthly time is billed at $125 per hour in 30-minute increments, with prior written approval before work begins.
Rush requests. Standard edit requests are returned within five business days. If you need a change handled ahead of the standard queue, a rush request is available at $250 per request, subject to availability. Rush handling is not guaranteed — we will accommodate it when our schedule allows and will tell you promptly if we cannot.
7. Hosting and infrastructure
The $75 monthly service plan bundles hosting, infrastructure, and service into a single fee. The plan includes:
- Hosting on Cloudflare Pages
- SSL certificate provisioning and renewal
- Security monitoring and DDoS protection
- Daily deployment backups
- Software and dependency security updates
- Uptime monitoring
- Performance monitoring
- Up to 30 minutes of content edits per month
- Priority email support (1 business day response, 5 business day standard turnaround)
- Continued access to ChileJam's design system as it evolves
Sites without an active monthly service plan cannot remain online. Termination of the service plan results in the site being taken offline as described in Section 10.
8. Client responsibilities
To make a project successful, we ask that you:
- Provide source material (existing copy, services lists, business descriptions, branding assets, photos) in a reasonable timeframe at the start of the project.
- Respond to questions and revision requests within 7 calendar days. Projects with no client response for more than 30 days may be paused, with restart fees due to resume.
- Keep your domain registration current and accessible.
- Keep your payment information current.
- Treat ChileJam team members with professional respect. Abusive behavior is grounds for immediate termination with no refund.
- Ensure that any content you provide does not violate copyright, trademark, or any other law. You retain liability for any content you supply.
9. Intellectual property
This is the section most clients have questions about, so we'll be specific.
What you own
- Your domain name, registered in your name through a registrar of your choice.
- Your content: text, photos, video, audio, and other materials you provided to ChileJam during the build.
- Your brand identity: any logos, names, marks, or brand elements you brought to the project or commissioned ChileJam to design specifically for you.
- The analytics data collected from your site, in accounts that belong to you.
- AI-generated images created specifically for your site, under a perpetual license to use them on your site and in your marketing.
What ChileJam owns
- The source code (HTML, CSS, JavaScript) that makes your site function.
- The design system, components, and patterns developed across our work — including any custom interactive components such as logo strips, navigation systems, or other unique elements.
- The build tools, deployment configuration, and infrastructure setup that supports your site.
- Internal management tools used by ChileJam to operate the service.
The simplest way to think about it: you're not buying a website from ChileJam. You're hiring ChileJam to provide a website for your business as a service. Your domain, your content, and your brand are yours. The code that makes it work is ours, the same way an architect's blueprints remain the architect's property even after your house is built.
Code release / buyout
The release fee compensates ChileJam for the custom code, components, and design system you'd be taking with you. We've priced it accessibly enough for a real move, deliberately enough that it isn't a casual decision.
If you ever want to take the source code with you and host it independently, you may purchase a code release for a flat fee of $2,500. The code release includes:
- A complete static export of your site (HTML, CSS, JS, images) as deployed at the time of release
- A copy of all content you provided during the build
- The right to deploy this static export to any hosting provider
- Continued ownership of any AI-generated images for your site
The code release does not include ChileJam's reusable design patterns, internal management tools, build configuration, or the right to resell or relicense the code to third parties.
10. Termination
Either party may terminate
Either party may terminate the engagement with 30 days written notice. On termination:
- Any outstanding balance becomes immediately due.
- If you have paid through the end of the current billing period, service continues until that period ends; no refund is provided for the unused portion of any paid period.
- At the end of the final billing period, your site is taken offline.
- Your domain is released back to you. Your content is provided back to you on request.
- Site files and source code remain ChileJam property unless the code release fee (Section 9) has been paid.
ChileJam may terminate immediately for cause
ChileJam reserves the right to terminate immediately, without refund, for the following:
- Non-payment of any invoice past 60 days
- Abusive, threatening, or harassing behavior toward ChileJam team members. This includes repeated personal attacks, threats, profanity directed at team members, insistent demands outside reasonable business hours, public defamation of ChileJam, or coordinated harassment. Strong disagreement about deliverables is not abuse; how that disagreement is communicated can be.
- Use of the site for illegal content or activities
- Material breach of these Terms
11. Refunds
Design work starts the moment a project begins. Time blocked on our calendar can't be unblocked. That's why fees are earned at the start of work, not at completion.
All payments to ChileJam are non-refundable. This includes:
- Build fees, including the 50% upfront payment, once design work has begun
- Monthly service plan fees, including for unused time within a billing period
- Add-on service fees
- The code release fee
If a project is canceled before any design work begins, the upfront payment is refunded minus a $100 administrative fee. Once design work begins, fees paid are earned regardless of project outcome.
12. Liability
ChileJam Productions provides services on an "as-is" basis and makes no warranties beyond those explicitly stated in these Terms. Without limiting the foregoing:
- ChileJam is not liable for business losses, lost revenue, lost data, or any indirect, incidental, or consequential damages arising from the use of services provided.
- ChileJam is not responsible for downtime, outages, or other issues caused by third-party services including but not limited to Cloudflare, Stripe, Google, Meta, Microsoft, or any other provider.
- ChileJam is not responsible for changes in search engine ranking, social media platform policy, advertising platform policy, or any other external factor that affects site performance.
- Total liability of ChileJam in any matter is limited to the total amount paid by Client to ChileJam in the 90 days immediately preceding the event giving rise to the claim.
13. Confidentiality
Both parties agree to keep confidential any non-public business information shared during the course of the engagement. ChileJam will not share, sell, or disclose client business information to third parties without consent, except as required by law or as necessary to provide the services. Clients agree not to disclose ChileJam's proprietary methods, internal tools, or processes to third parties.
14. Changes to these Terms
We may update these Terms from time to time. The current version always lives at this URL. We will notify existing clients by email of material changes at least 30 days before they take effect. Continued use of ChileJam services after the effective date of an update constitutes acceptance of the updated Terms.
15. Governing law and disputes
These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws provisions. Any dispute arising from these Terms or from ChileJam services will be resolved first by good-faith negotiation between the parties. If negotiation fails, disputes will be resolved by binding arbitration in Denton County, Texas.
